Neptune’s Nautical Academy

By enrolling in any course, booking training, or using the services of Neptune’s Nautical Academy (“we”, “our”, “us”), you agree to the following Terms & Conditions.

1. General

  • Neptune’s Nautical Academy operates as a training division of Neptune’s Divers & Cruises (Pty) Ltd, based in Hermanus, South Africa.

  • We are an RYA (Royal Yachting Association) Recognised Training Centre, offering internationally accredited Powerboat and PWC courses.

  • These Terms & Conditions apply to all students, participants, and users of our services.

2. Course Enrolment & Eligibility

  • Students must be 16 years or older to attend RYA Powerboat Level 2 and PWC Proficiency courses.

  • Course spaces are confirmed only once full payment or deposit is received.

  • All students must provide valid identification (ID or Passport) for certification purposes.

  • Medical conditions, disabilities, or requirements that may affect participation must be declared in advance.

3. Payment, Cancellations & Refunds

  • Course fees are payable in advance unless otherwise agreed in writing.

  • Cancellations by the student:

    • 14+ days before course start: Full refund (less admin fee).

    • 7–13 days: 50% refund.

    • Less than 7 days: No refund.

  • Cancellations by the Academy: If we cancel due to weather, instructor availability, or safety concerns, you will be offered a re-schedule or full refund.

  • No refunds are given once a course has started.

4. Safety & Conduct

  • All training is carried out in line with RYA standards and SAMSA safety regulations.

  • Students must follow all instructor instructions at all times.

  • Buoyancy aids and safety equipment must be worn when required.

  • Alcohol or illegal substances are strictly prohibited before and during training.

  • Disruptive or unsafe behaviour may result in removal from the course with no refund.

5. Certification & Assessment

  • Certificates are awarded at the discretion of the instructor based on competence, attendance, and participation.

  • Completion of a course does not guarantee certification if the required standard is not met.

  • Replacement certificates (lost/damaged) may incur an admin fee.

6. Liability & Insurance

  • All activities are undertaken at the student’s own risk.

  • Neptune’s Nautical Academy, its instructors, and staff are not liable for injury, illness, death, or loss/damage to personal property, except where required by law.

  • Students are strongly advised to take out personal insurance to cover cancellations, accidents, or overseas travel (if applicable).

7. Use of Images & Media

  • By participating in courses, students consent to photos and videos being taken for training and marketing purposes, unless they request otherwise in writing.

8. Privacy & Data Protection

  • Personal data is collected and processed in line with our Privacy Policy, POPIA (South Africa), and GDPR (EU/UK).

  • Student details may be shared with the RYA for certification purposes.

9. Governing Law

  • These Terms & Conditions are governed by the laws of South Africa.

  • Any disputes will fall under the jurisdiction of the South African courts.
